PulseCast — Terms of Service

These Terms govern your access to and use of PulseCast (the "Service"), operated by Lucas Centomo — Entrepreneur individuel (Wioxpro), SIREN 108 426 750, 17 Avenue de Lapeyrière, 31240 Saint-Jean, France. By creating an account or using the Service, you agree to them. Contact: pulsecast.tv@icloud.com.

1. What PulseCast does

PulseCast ("we", "us"), operated by Lucas Centomo — Entrepreneur individuel (Wioxpro), SIREN 108 426 750, 17 Avenue de Lapeyrière, 31240 Saint-Jean, France, is a service that streams a video you upload, on a continuous loop, to a streaming destination you choose (YouTube, Twitch, Kick.com, Facebook, or any RTMP endpoint), 24/7, from our servers. You ("you", "the user") control what is streamed and where.

2. Your account

• You must provide accurate information and keep your login secure.
• You are responsible for all activity under your account.
• You must be old enough to enter a binding contract in your country.

3. Your content and your rights (important)

• You may only stream content that you own or are licensed to broadcast.
• You are solely responsible for the video you upload and stream, and for complying with the rules of the destination platform (e.g., YouTube, Twitch).
• You must not stream content that is illegal, infringes copyright or trademarks, is defamatory, hateful, sexually exploitative, or otherwise violates any law or third-party right.
• You grant us only the limited technical permission needed to store, transcode, loop, and transmit your video to the destination you configure. We claim no ownership of your content.

4. Acceptable use

You agree not to:

• Stream content you don't have the rights to.
• Use the service for spam, fraud, malware, or to harass others.
• Attempt to disrupt, overload, reverse-engineer, or gain unauthorized access to the service.
• Resell the service without our written agreement.

We may suspend or terminate a stream or account that violates these terms or that we receive a valid complaint about.

5. Billing

• Paid plans are billed monthly and priced by the number of simultaneous channels.
• A live stream requires an active paid plan. You can create channels and manage settings without paying; you are only charged for keeping a stream on air.
• Payments are handled by our payment processors, Stripe and Whop, depending on where you subscribed. Whop is the merchant of record for purchases made through whop.com/pulsecast; Stripe processes subscriptions taken out on pulsecast.tv. By subscribing you authorize recurring charges until you cancel.
• Cancel anytime — your channels stop streaming at the end of the current billing period. We do not provide pro-rated refunds for partial months unless required by law.
• Prices are shown in USD; your bank may charge in your local currency.

6. Service availability

• We aim for high availability and automatically reconnect streams that drop, but we do not guarantee uninterrupted streaming. Outages can happen on our side, on your network, or on the destination platform.
• We may perform maintenance and may change or discontinue features.
• We are not responsible for actions taken by the destination platform against your channel (e.g., strikes, suspensions), which are governed by that platform's own terms.

7. Suspension and termination

• You may delete your account at any time.
• We may suspend or terminate accounts that violate these terms, that we're legally required to act on, or that abuse the service.
• On termination, your uploaded videos and channels may be deleted.

8. Copyright / takedown (DMCA)

We respond to valid copyright complaints and will remove or disable streams that are the subject of a valid notice. Repeat infringers will be terminated. Send notices to pulsecast.tv@icloud.com.

9. Liability

The service is provided "as is." To the maximum extent permitted by law, we are not liable for indirect or consequential damages, lost revenue, or losses arising from stream interruptions or platform actions. Our total liability is limited to the amount you paid us in the previous 3 months.

10. Changes

We may update these terms; we'll post the new version and update the date above. Continued use means you accept the changes.

11. Governing law

These Terms are governed by French law. Nothing here removes rights you have as a consumer under the mandatory law of your country of residence.
